Legal Question in Workers Comp in Virginia

Does my husband need to pursue a 7% permenant disabily to his arm, with the work

My husband was injured on the job about a year ago. He had to have surgery on a disc in his neck. He now has a metal plate, a cadavier bone and 4 screws in his neck. His doctor has given him 7% permanent disability on his arm that was affected by the nerves being pressed against the spine. Two of his fingers are numb on the ends. We had not heard anything from the ins. co. I called them recently. We were wondering if the 7% is worth pursueing? He still has some pain with his neck. Any help would be appreciated.

Dear Mam:

If your husband is currently receiving Workers Comp then no he cannot receive the 7% at this time. On the other hand if he has returned to work in either a part time or full time capacity, then yes he should apply for this and obtain the additional 14 wks of compensation. Has your husband filed his claim?(Two years is the

statute of limitations.)

A 7% per cent disability claim might well be worth pursuing as it could conceivably turn into something considerably larger(hopefully not)

as time goes on.
