Injured while driving school bus

was injured will driving a school bus I was rearended by a car. I now have partcial disability. and am unable to return to bus driving . am I able to get a settlement from the other drivers insurance and workers comp. the other driver only carried the minimal Insurance. and wont even cover the medical bill.

With my 35 years of experience as a Virginia Workers Compensation Lawyer, I can tell you that you have a difficult situation. You indicate while working and driving a school bus, you were rear ended by another vehicle. That vehicle had little insurance. I assume you are now on workers compensation for your accident. I assume workers compensation has paid for your medical bills. If so, workers compensation has a lien on your PI case. If this lien exceeds the insurance carried by the other driver, then it will be difficult to recover anything from the other driver. You must be very careful that you do not do anything to forfeit your rights to workers compensation. Settling with the other driver without the consent of the workers compensation carrier would forfeit your workers compensation rights. You need to consult an attorney who can understand both the personal injury and the workers compensation issues in your case.
