Virginia Workers' Compensation Law does not require the employer to take back an injured worker with restrictions. However, if there is no restricted work available, then the injured worker is entitled to collect compensation benefits until they return to work. It is important in Virginia that you can prove that after the employer refused to let you return, you actively looked for other work within your weight restrictions.
