Legal Question in Workers Comp in Virginia

Is it enough?

I was injured at work and can no longer do my job, dotors say my knee hasa 10% workmans compensation rating. The insurance has offered me 45,000 to settle is this a good offer?

Dear Sir:

If you cannot do your current job, then the issues are: (1) are you currently receiving weekly compensation; (2) if you cannot do your pre-injury job, what are the chances you can work somewhere else and earn an equivalent income; and (3) you have been offered $45,000 but this does not include any future medical coverage so another issue would be what are the chances you would need future medical coverage or care for this knee problem?

These are some of the considerations that would go into whether or not this is a good offer.

You say that you received an on the job injury to your knee which, apparently, prevents you from doing the job you were doing and that doctors have given your knee injury a 10% workman's comp rating which the employer's insurance carrier is now offering to settle for $45K.

More information would be needed to even make a ballpark guess at your

inquiry such as what other jobs within this field/industry would be available for you to work at or must you now seek a completely different line of work?

However, even without knowing the answer to the above as well as other related information, knowing the modus operandi of insurance companies, I would think that it's likely that they've "low balled", so to speak, the amount of their settlement offer.
