Legal Question in Workers Comp in Virginia

after i get my judgement from the state how do i collect

i am going to court tomorrow with workman's comp. i am the one taking them to court for not paying one of the bills that they gave authorization on and recinded after the mri if i win my case how do i collect the 1000.00 that they owe me

If you obtain a judgment against the insurance carrier and they don't appeal, they will normally pay it. If they don't, even after you send a demand letter with a certified copy of the judgment, you could then record a lien and ask for a writ of attachment that would empower the Sheriff to seize and sell some of their assets sufficient to settle your claim.

Dear Sir: If the Virginia Workers Comp Commission awards you your medical bills, the insurance company will be required to pay them. You will have to show your medical bills are reasonable, necessary, and related to your accident. If you have also lost time from work, then you need to file a claim for that. Any claim for Workers Comp in Virginia has to be filed within two (2) years of the date of the accident. You can call or email for a brochure that further explains your rights.
