Legal Question in Workers Comp in Virginia

Request for Review

I received an opinion in my favor and my employer has filed a request for review. In the review the reasons stated were that they disagreed with the deputy commissioner. I read online that a review would be granted when the request was based on a factual error. How then could the review have been granted.
