Legal Question in Workers Comp in Virginia

Responsible

When hurt on the job the employer has to pay the bills when I knew that they had workman's comp insurance. How long do you have to file against an employer for non-payment, which in turn a judgement was placest against me for the bills. The employer told me to bring in the bill and to repay me for it but will not now.

Re: Responsible

You, apparently, have not filed a formal claim with the Virginia Workers' Compensation Commission

and, therfore, are relying on nothing more than the goodwill of your employer to take care of your medical bills.

You have two years from the date of your on the job accident to file your claim and until you do so you will have no assurance that your medical bills will be paid(by someone other than yourself).

Re: Responsible

Dear Sir:

To ensure payment of medical bills after being hurt on the job, you must file a Claim for Benefits with the Virginia Workers Compensation Commission. You have 2 years after your date of accident to file this Claim. You can call the Commission at 804-367-8699 for the form. Once you are granted an Award by the Commission, you have lifetime medical benefits for your injury.
