Legal Question in Workers Comp in Virginia

Statute of Limitations to notify employer

How long can an employee legally wait to notify his/her employer of a possible work related injury?

Is the employer responsible for paying the employee during the missed time or is he/she reimubrsed through Workmen's Comp?

Re: Statute of Limitations to notify employer

As a practical matter you should notifiy an employer immediately when an accident occurred. Most employers have policies requiring prompt notice. The Workers Comp Act requires notice within 30 days of the accident. The Employer' Workers Comp Ins is required to pay for all medical bills for a compensable accident and lost time after 7 days. If the period of disability exceeds 7 days, then the first 7 days must also be paid.
