Will they state award additional money for back surgery''pain and suffering'' in addition to The insurance payments?

Unfortunately, no. There is no money for "pain and suffering" under workers compensation.However you do have a few options.You have the benefits for lost wages and lifetime medical beneifts.Also, if your back injury is severe enough that you loose range of motion in your legs or arms, you may be able to get permanent partial disability payments.Another option is to settle your claim for a lump sum of money, but that means giving up your benefits including medical benefits.

No. However, there are various other additional benefits available and you should have an attorney help you. If this is a claim agains the state, please note that the Commonwealth of Virginia does not typically offer large settlements. Have an attorney assist you. Good luck.

As a Virginia Workers Compensation Lawyer for 35 years, I can tell you Workers Compensation only pays you for lost wages, permanent injuries, medical expenses, mileage, and cost of living adjustments. It does not pay for pain and suffering.
