Legal Question in Workers Comp in Virginia

work or not to work???

I'am a truck driver in virginia . I got here in an accident caused by another driver while driving a company truck. Now when I go to physical therapy (as the company has been instructed by the workmans comp. insurance company rep.) I must comeback work and work, BUT at workmans comp. rates. Not at my presnt salary.

If you have a workers' compensation claim, then you are eligible for the insurance company to pay you for your lost time. The Rate you are paid is two thirds of your average weekly wage while you were working. If you are still working, you should be paid your prior salary unless you are working a light duty job. Then, you can be paid a lower salary but workers comp ins should pay you the difference. Please call me if you have additional questions.
