Legal Question in Workers Comp in Virginia
workers comp
I had asked a question but had left out some of the facts.I was asking about a wc hearing that I have coming up next month.I had spoke to several lawyers who told me that I did not have a case. In 2006 I tore my rotator cuff while lifting a heavy board.it was a accident that happen suddenly, because I thought that I had only pulled a muscle I told my team leader who just put me on another job. I went to the dr and she took me out of work for a week and gave me some meds. still not knowing that I had a torn rotoator cuff.I went back to the dr she sent me to a bone and joint dr who gave me a shot and sent me back to work still not knowing that I had a torn rotator cuff tear. This time I file a workers comp claim but it wasn't till march. Because my ins ended the day before my surgery and I was fired two day after my surgery am I entitled to any thing. I am still in pain because I never received rehab for my arm which I still do not have full use of will I receive anything

Re: workers comp
Dear Sir:
Did you file the Claim for Benefits with the Virginia Workers Compensation Commission prior to the end of the two year statute of limitations from the date of your accident?
If not, why not?
Does your doctor or doctors relate the rotator cuff tear to the lifting of the heavy board in 2006?
Was an Employer's First Report of Accident filled out for the injury?
For what period of time did your doctor have you out of work due to this injury?
Why did the insurance company deny the claim?
