Legal Question in Workers Comp in Virginia

want worker's comp to be settled and done with

I was injured at work on 12/20/04, diagnosed w/ severe tendonitis. After almost a year of receiving benefits and medical attention, it seems I have reached MMI. I have another job waiting, but hesitate in the event surgery for my injury is needed down the road. What would be the possibility of receiving a small lump sum settlement from the insurance company, if I were to cut them loose from any further obligation? I just want this over and done so I can move on with my life. Thanks

I understand your frustration with the system but you must be very careful about signaling to the insurance company any desire to settle your case. A case settlement depends upon the degree of future exposure the insurer has whether it is for compensation or medical bills. The more exposure they fear the more willing they are to settle the case. Conversely, if you are going to be released with no restrictions, the insurer may feel the case is over with and offer no settlement. Each case is different.
