Legal Question in Workers Comp in Virginia

workers compensation

on 2/12/04 had lower back and leg injurie work comp paid for my time off work,medical bills etc. on 11/06 pain was still in back and down both legs,doctor said i needed another bylaterial injection ,after giving me a hard time about waiting so long in between doctor visits they said ok. i explained to them i always in pain but i try to go as long as i can. now i am need of another injection on 2/19/09 and there telling me it's been to long they have closed out my case,can they do this?

As a Virginia Workers Compensation lawyer for 35 years, I can tell you that you may have a statute of limitations problem. You were supposed to file a claim for this injury with the Virginia Workers Compensation Commission within two (2) years of the date of your injury. Since your accident was five (5) years ago this may be a problem. You can contact the Commission to find out if you can still file a Claim for Benefits.
