Legal Question in Workers Comp in Virginia

workmans comp

i busted my finger at work due to having pot holes in are yard that they wont fix. it happen at nite and i did not think much of it till the next morning when i reported it to a supervisor and told him that it appeared ok but just in case when i woke up and it was swollen. well i woke up and it looked like someone had hit me with a hammer so i went to the emergency room where they did xrays and could not determine if it was broke or not so they put me out of work till i seen a hand specialist.in the mean time my boss calls and i tell him whats going on and he tells me not to make the appointment for the specialist to go to the company doctor so i did while i was there i asked the nurse why i had to come there that i was already under doctors care and she said that the company had a contract with them and we had to come there and i asked we have to come here to keep from being out of work cause the first thing the doctor says is we going to get you on light duty.well how can you go from seeing a specailist to going back on full duty. being a company doctor there only goal is getting you back to work so how many people go to this facility and needing to have medication for pain dont get it due 2 not being able to drive

Re: workmans comp

In NC, the employer generally can direct your medical care if they are also paying the bills. You can always ask the NC Industrial Commission to Order the defendants to pay for treatment with your own doctor. You should have a good reason for the change and make it in writing to the Executive Secretary's Office of the NCIC. You can get to the NCIC website for contact information by going to our links page at ncworkcomp.com. While on the NCIC website, go ahead and read the Bulletin, which explains the system. Also print a Form 18, fill it out and mail it to the NCIC and employer ASAP to make sure your claim is correctly on file. Good luck!
