Re: Bad checks getting sued, Can I bankrupt
If your court case is a criminal case then filing bankruptcy will not help. If your case is a civil collections action then filing bankruptcy will stay all civil proceedings. In other words, any collection must go through the Bankruptcy court, not the Superior court AND they cannot harass you any more for debts incurred prior to your bankruptcy filing. When you are discharged, you no longer have to pay any of the debt incurred prior to bankruptcy.
I wish you the best of luck with your case.
