My rights as a private seller

I sold my 1988 chevy spectrum privetly. I made a contract that with very easy payment plan. I sold the car for 800.00 and have recieved 300.00. This was my first time selling a car and I signed the title over, because I didnt want anything to be blamed on me while the car is not in my possesion. They signed the contract and I have documented how much they payed. I know now that I cannot reposess the car now because of the title. My questions are if I take them to court and ask for my car back will I have to repay the 300.00 they have already given me? Do I have any rights of the car since they signed a contract? Should I try small claims court. I really need help, I cant find anything on my situation. Thank you for your time and help.

I would highly recommend the use of small claims court in this matter.

It is structured in a manner to give you the best opportunity for success in this

matter, without having to spend a substantial amount on attorneys. You may

be able to get the car back, or force them to pay the remaining amount of money. If

the judge rules that they must pay, you can seek a writ of garnishment to take it out of

their wages, or be able to execute on other property to get your money (of course the easiest

way is to get the car back).
