Legal Question in Disability Law in Washington

forced to go into work

I was recently terminated from my job. Well actually I was given the option of resigning so I can collect unemployment and keep my benefits another month. I was forced to go into work despite the fact that I was on FMLA. Because I was forced to go to work while I was sick and made mistakes because of this. No accomodations were ever made or suggested by my employer. Should I be contacting an attorney or government agency?

Re: forced to go into work

To be covered by FMLA there must be at least 50 employees and you must have worked there at least a year. The employer should not have made you go in while you were ill.

You may also be covered by the laws protecting you from disability discrimination. You can call the WA State Human Rights Commission to check with them.

You can also talk with the WA State Dept of Labor and Industries about FMLA.

After you talk with those two agencies would be the right time to talk with an employment attorney in your county.

Good luck!
