Legal Question in Disability Law in Washington

my son's disability

My son attends a small private school. He is in the 4th grade and has Aspberger's syndrome. We were completely up front with school prior to his acceptance there. Now, half way through the school year just in time for the holidays they are expelling him with no warning.

What reasons were you given for the expulsion?

If the school receives any type of state or federal funding your son is definitely covered by WA and/or federal law.

If the school is a private, religious school without government funding, I'm not sure whether your son is protected without doing some research.

I suggest you start by contacting both the WA State Human Rights Commission (main office is in Olympia and they have a toll-free number) AND the Dept of Education's Civil Rights Office (office in Seattle).

Remember that everything is a he said she said without documentation. That said, threatening a lawsuit might help if your son should be in there.
