Legal Question in Bankruptcy in Washington

I am leaving my spouse going to WA in April and filing for divorce & custody when i get there. Taking no property other than clothes, toys, pictures,a few cd's,books,possibly a computer (not worth much) for help in getting work. Will i have to sell anything to file chp 7? I am leaving everything else behind, (except my baby) starting over. Will I have to pay for credit card transactions made within the last 6 mo? i will have almost no money & have to go on welfare/food stamps until i find steady work.

Watch Out for Residency Requirements

If you move to Washington, you may not be able to file for bankruptcy there for at least 3 months. You can only file in the district in which you have resided for the greater part of the last six months, which I am presuming at present is Hawaii. From the property you have described, it sounds like it will all be "exempt" and you will not have to "sell anything if you file chapter 7." You should be able to keep it all. As for the credit card transactions made within the last 6 months, if they were not "luxury charges," the credit card debts will probably be discharged in your bankruptcy and you will not have to "pay" them.
