That depends on a lot of things: In what capacity is he making the decisions? What agreements are in place about his right to make those decisions? Who else is involved? These are just starters. I offer evaluation consultations at no charge. I've been a business lawyer since 1975. Call me at (206)624-6761 if you think I might be able to help.
As a Franchise Attorney I agree with the other attorney answer. There are too many unknowns that are not stated in your question, including how your brother is vesting with rights to make your business decisions. Consult with a good business or franchise attorney in your area for specific advice.
