Domain Dispute - No trademark

(this is an example because I don't want to use real names)

I created a company 3 months ago called Mocha Xtreme Coffee LLC. At that time I created a website mochaxtremecoffee (dot) com

A competitor in the area is named Jumping Java. I just found out from a letter from their lawyer that their website is mymochaxtreme (dot) com and they want me to give them my domain. The letter said that now, they are filing a trademark for mochaxtreme.

Am I safe? Or are they going to follow through with a lawsuit and win? Everything has my domain printed on it, and I don't want to change it.

I can't directly answer your question for you, but I have two suggestions.

First, try reposting this question under "intellectual property". Trademark law is a very focused area.

Second, because the other side has already retained a lawyer in this dispute, my best recommendation would be to get an attorney who handles intellectual property, particularly trademark issues. There may be some steps that you would need to take quickly to protect your rights and unless you prefer to just relinquish your domain, now is not the time for self-help.
