Legal Question in Business Law in Washington
Illegal Billing by Security Alarm Comapny
I have a burglary alarm in my house and subscribe to a monitoring service that bills me monthly for their ''service''. Last June, my mother in law set off the alarm because she didn't tell me that she was coming.
The monitoring service called me and I told them to not dispatch the police and the police did not respond. A few months later, I received a bill for $106 from the monitoring service and they claimed that they were billed that from the City Police. However, the Police did not bill them, nor did they dispatch a patrol car to my house. The monitoring company keeps sending me dirty letters that I have to pay them $106 for the incident. I then challenged them to provide proof that the city police billed them for the incident, and they couldn't produce it. and in fact the first woman I spoke with told me they they had no record of being charged, however, it was after business hours so she told me to call back the next day which I did. I told them to fix it immediately or I will sue.
My question is: Can I sue them for trying to falsely charge me for a bill that they never received? I'm sure that they are getting loads of meny from people not as dilligent as I am. Is there a chance to start a class action lawsuite?

Regarding your particular situation, you have a couple of options to pursue. First, I would encourage you to contact the Consumer Protection division of the Washington State Attorney General's office. They address situations such as yours. Second, you may want to take this matter to Small Claims Court.
