Legal Question in Business Law in Washington

Limitations on refunds

I purchased an extended warranty 2/5/01 on a 30 day money back guarantee. I canceled it on 2/17/01. I have contacted them on numerous occasions and even spoke with the chairman of the company. I have received no refund of satisfaction. I submitted a complaint to the BBB but have heard nothing from them yet. Since I live in a different state from the warranty company, I would have to go to Washington to take action in court. I heard, from a friend, that the statute of limitations runs out after a year. My question is, after a years time, is the warranty company still liable for my refund or have I just lost my $294.00?

Re: Limitations on refunds

If all you want is a refund, the Washington statute of limitations on written contracts is 6 years. If the warranty company actions constitute violations of the Washington Consumer Protection Act (generally, deceptive and misleading practices in commerce), you may be eligible for an award of your attorney fees and a tripling of your damages. If you want more information, I can be reached at (206)624-6761.
