Legal Question in Business Law in Washington
Overpayment of wages
My employer is a public hospital in Washington state. When I accepted a 'lead' position, I was informed to clock in under 'charge' in order to be paid my lead pay. Now 2 years and 3 months later, they state they have 'overpaid' me by $4000 and I must pay it back, as my lead pay was included in my regular wages. I have proceeded in following with RCW49.48.200 law, but am still wondering if there is nothing else I can do.

Re: Overpayment of wages
It depends. If the amount you were being paid during the two years and three months of "overpayment" was actually at the rate that was agreed upon, you may have some additional options. (For example, if you were told that you would be paid $20/hour as a lead, and your pay worked out to be $20/hour in fact.) However, if the rate was more, you will have to pay it back as provided for by statute. (Continuing the example above, if your pay actually worked out to be $21.50/hour, even though the pay rate you were promised was $20/hour, then you would have received more than promised.)
