pay offers
This employer offered 22.80 hour,
then only payed 19.01 hour later
stating that the 3.79 was for
benefits.. but still had to wait 90
days before benefits would start.
They claimed the amount would go
into my 401k (vested) until bene's
kicked in. I worked for 9 weeks for
this company while trying to find a
better job. To date, I have not seen
my approx 1300.00 they owe. 1st is
this legal offering pay through
advertisement and then changing
it? Second, can I bring them to
small claims for the amount owed?

If they told you up front during the interview that the pay would be lower, this might be legal. It would not be legal to tell you that you would be paid the higher rate and let you discover upon review of your first paycheck that this was not the case. Contact the Dept of Labor & Industries, who will assist you with collection of unpaid wages. However, I would recommend getting another job first.
