phone directory omission two years in a row

For the second time the phone company has failed to include my small antique/collectible shop in the white and yellow page directory and the information (411) listings. Service started in July 2000, within time frame for new publication. I was credited the difference between business and residential rates up to July 2001 and assured in writing on my statement that the listing would be in 2002 directory. Not included again, customer service said necessary forms to publisher were not sent - that only computer message was used. I know I have lost sales because of this...this is a tourist area and not being listed under Antiques in the yellow pages has had a drastic impact. Plus customers that have decided they wanted something after leaving the area have not been able to get my number from information to make a phone sale. What recourse, other than small claims court do I have?

The Sales Contact/Agreement that you signed to place the advertising probably (almost certainly) holds the company harmless from mistakes or omissions. You need to do a a negotiating job, to convince them to give you something such as several years free, or something else, and not to threaten them with a lawsuit that you can't win. Read the contract.
