Legal Question in Business Law in Washington
I work in Seattle, WA as an Inside Sales Representative doing B2B first aid supplies sales. Part of my job REQUIRES that I record calls, using a Olympus recorder that is plugged into my desk phone. I know Washington is a two-party consent state, as well as 11 other states around the country. But in these situations, we are just hitting a "record" button, without the other person's consent or knowledge. Most companies have pre-call promt "this call might be monitored or recorded for quality control purposes", but ours obviously does not. I have brought up my uneasyness of the situation to management, but their answer is always "we are just using it for training, and we delete them eventually." Is this in violation with the law?
1 Answer from Attorneys
Yes, it is. The law makes no distinction based on the purpose of the recording.
