Legal Question in Civil Rights Law in Washington
Improper seizure procedures
I had two items seized by the Auburn police 1). my truck 2) all the money in my checking account. In both instances, I filed a claim immediately. Concerning my truck - a 2003 Ford Ranger:While I was waiting for a notice for a hearing, I received a repossession notice from Ford Credit. When I called, I was told I could get my truck back if I paid off the loanwithin 10 days. Then a day later, I was told it was too late - the payment would not be posted in time. Then I was told that the police had directed that there be no way possible for me to recover my truck. The next day it was already at auction. According to law, I am entitled to a hearing. I had put $15000 down on the truck - now I have no vehicle & no money. Concerning the $9000+ in my bank account: The Auburn police froze it 7/28 - I received notice on 8/11. In the meantime, I knew nothing about it and wrote checks as usual. I filed a claim on 8/12, and have yet to hear anything about a hearing. So now I really have no money - 16 checks have bounced - insurance cancelled - phone shut off - credit destroyed.
