Legal Question in Civil Rights Law in Washington

unlawful incarceration

I was held in jail for fifteen days beyond my committment. It was and has been aknowledged by the court clerk to have been due to an error in the paper work.

I have been told that the out of court settlement value for this type of thing is $1500/day.

What do I need to do next to collect?

Re: unlawful incarceration

As a preliminary matter you should file a claim with the city. Each government subdivision has a filing procedure, and you will need to conform with that. This is preliminary to sueing the government subdivision on state law claims, on the federal law claims that claim procedure is not required, but you still want to make a claim, either using the claims procedure or with a demand letter, this is also preliminary to sueing the government subdivision.
