email tampering

about one year ago someone accessed my private email account (she got the address and password from my ex-husband) and pretended to be me...she replied to one (possibly two) emails as though she was me. She confessed it to me a day or two later. She has not done anything more since then, but I am wondering how can I prove she did this (it was a Yahoo account). I am currently wanting to take legal action...is there anything I can do to seek legal recourse on this? Is it a felony offense? I have been told it is. would this be difficult to prove? It has been almost one year. I did print out the email pages, but it only shows as though it came from me / my account.

Yes, it is a trespass. As to the technical aspect of whether it can be proven. You may need to have a forensic examiner to conduct the examination to collect the evidence. Some systems keep logon records (the pc itself or the email server). I don't know the specific details of yahoo's logon records. A big challenge here is that unless you can show some kind of actual injury, most police departments are not going to want to expend the amount of resources required to put the case together.
