Estimate = Contract?

We are a internet development company. We have a client threatening to sue due to ''breach of contract'' because we did not complete all of the items that we listed on an estimate. Can an estimate be considered a contract?

Did you have a separate contract that identified what your obligations were, or was the estimate the only documentation you used? If there was no separate contract, the answer may depend upon the wording of the estimate, the correspondence surrounding this estimate, and ultimately what the expectations and intentions of the parties were. A further review of your situation would be needed to give you a more definitive answer.

The answer that Mr. Pepper provided is consistent with Washington law. The details of the language of your estimate may make the estimate a contract. This is really just a contract or sales general business question not a Computer & Technology Law question.
