Legal Question in Consumer Law in Washington

Credit card fraud

I recently had to cancel my debit card because Columbia House DVD Club was applying charges to it every week for items I had not received or purchased. I emailed them several times asking them to stop but they did not. There is no way to get ahold of them by phone either. They charged my card 5 times incurring overdraft fees. What can I do to get that money back?

Re: Credit card fraud

You can write to them. Phone calls are useless, as you have noticed. Emails are valid, but whether or not they are being received is debatable. Send a certified letter and a regular first class letter as well, and send a copy to the Attorney General's office, and keep a copy.

If you read the very fine print on your agreement with the bank, you'll see that the bank can (and will) charge you for overdrafts.

If you can prove that the overdrafts are solely due to Columbia making unauthorized charges, then you *may* be able to sue Columbia to recover your overdraft charges.

Shutting down your debit card was a very good idea. Now, write to Columbia and demand that they refund the money they took without your authorization.

The AG's office may be interested. Hope this helps. Powell
