Legal Question in Consumer Law in Washington

Fitness contracts

I need to know if it is legal for a small fitness business to sell my contract to a bank without my consent.

Am I legally bound to the contract under the banks terms, even though I never saw or signed their contract?

Re: Fitness contracts

Fitness center (gym) contracts are the subject of their own statute. Look under RCW 19 misc. business regulations.

They don't make money having you drop in, they make money when you allow your account to be debited automatically - and endlessly.

You appear to have a contract with a fitness center. Read it. See what it says precisely about whether the contract is assignable and under what conditions.

Or, are you in default? Or, do they have a unilateral right to transfer the contract to a third party without your consent by the express terms of the contract?

You can only be held to the contract you signed. Other consequences may arise in the event of default on your part.

The Consumer Protection Division of the Attorney General is a good resource for issues like this.

I hope this helps answer your questions -

Powell
