Real estate developer falsely advertised common area

Five years ago we bought property in a planned development in which the developer advertised the common area as consisting of 3,500 acres. He has been advertising this ever since, yet we recently learned that he has been selling off pieces of the common area to private owners and that our common area has shrunk to 1,000 acres. Isn't this illegal?

It isn't necessarily illegal but it may be unlawful and it certainly sounds as though it is a breach of the contract you signed.

He probably advertised it correctly five years ago - how do you know what he is now advertising? Did you see a new advertisement?

If you relied on his representations that there was XXX common area, and you can prove there is now X common area, you may have a claim.
