Legal Question in Consumer Law in Washington

Sales Orders

We signed a sales order for the purchase of a hot tub. The salesperson called back later and said a mistake was made, and they want to increase the price. Are they legally bound by this sales order that was signed by me?

Re: Sales Orders

Turn the situation around. Say that you called the salesperson, told him there was an error in the price and you wanted to decrease the price.

That wouldn't work.

The issue is whether there is a meeting of the minds, or if there was some sort of mutual mistake. If the salesperson made a mistake, that's not a mutual mistake, but a unilateral one. He's going to have a hard time explaining it and keeping your business.

The agreement that you understood is memorialized by the purchase agreement you signed. It is not lawful for the salesperson to attempt to re-negotiate it afterwards.

Barring some circumstance I don't see in your facts.

Hope this helps. Elizabeth Powell
