Legal Question in Consumer Law in Washington

-Unauthorized Auto Repairs-

I've taken my car to Transmission shop to look at it. They went ahead and put in an MLPS part to it with out my ok. I took the car from their lot on Saturday, while they were closed, not knowing that they had put that part in.

Who is at fault here? My taking my car off their lot without knowing, although I did call their office and leave a message. Or theirs for installing parts into my car without my ok.

And did you leave them a key? Did you have another key to go get it?

They should not have done repairs without authorisation, and you should not have taken your car away (no matter what you knew or did not know about what they did or didn't do).

You need to get over the issue of fault. Now, your job is to fix the problem. It would be stupid to have them un-install the part. They conferred a benefit on you, so you need to pay them for what they did.

Granted, it was not smart of them not to have written authorization but if I were in Court listening to the two of you argue this I would be thinking, "He took the car there; they discussed something, because they did the work, and then he took the car without paying for the work and claimed they didn't have authorization. Hmmm." Then I would award judgment to the shop.

Now, other attorneys may see this differently. This is just my take. I hope it helps you. Elizabeth Powell
