Legal Question in Credit and Debt Law in Washington

11-year old debt

I received a call from a collection agency about a debt that I have absolutely no recollection of. They state that it is from 1996 and through a bank Visa I haven't heard of. I haven't even seen this on my credit report before. If it is my debt, can they even collect on it 11 years later?

Re: 11-year old debt

If your statement is correct and there are no other relevant facts then no, the statute of limitations has passed and the debt is time barred.

Demand they give you their address, write to them certified, and demand that they verify/validate the debt. Save a copy of your letter.

The scary thing they do is to 're-age' the debt, e.g. make it look like you made a payment more recently, which would start the SOL clock over.

If somebody shows up with a summons and complaint, please don't hesitate to contact me.

Hope this helps. Elizabeth Powell
