my brother and his wife were in the middle of a divorce. She gave her power of attorney to her father.The wife was dying from Lou Gehrigs disease she was the one who filed for divorce. The divorce was finalized on the day she died my brother was holding her in his arms when she passed and her sisters were present and had no problem with this at all. The father took every thing out of the house including her Suburu that was only three years old. My brother had signed the house over to his wife before the divorce because that is what she wanted. Is the person with power of attorney responsible for her debts Including the house payments? He sure made sure he got all the assets and he does have a good amount of money but my brother is getting stuck why?

The date of filing of the petition for dissolution of marriage cuts of community liability for debts. The first person in line for claims on assets of the deceased's estate are the creditors of the wife/sister.
