Legal Question in Credit and Debt Law in Washington
Car Loan deficit
I am on Social Security disability and am being harrassed by a collection agency regarding the repossesion of a car I helped my son buy. He told me I could be thrown in jail for signing for an auto loan I couldn't pay for. It was only to be in my name for two months then my son was to finance it in his name. Help, they have me terrified!

Re: Car Loan deficit
Please be calm, you have nothing to worry about. Please contact the AG as soon as you can and report the collection agency. Then use Google to look up pennlawyer.com and budhibbs.com, both of which are excellent sites on common abuses of the Federal Fair Debt Collection Practices Act.
You are getting abused by a collector. Collectors cannot threaten to take action that is not lawful. You cannot be thrown in jail over a repoed car. Your remedy is $1,000 for each violation.
You cannot record the collector, but any messages they leave are valuable evidence. You can have an attorney explain how to transcribe them properly.
There are attorneys who will do this with no up front money from you. None. Please consider this method.
You could look at avvo.com for an attorney who does collection actions.
Hope this helps. Elizabeth Powell
