Legal Question in Credit and Debt Law in Washington
collection
i received a collection notice in the mail that is at least 12 years old. They state in there that if i pay half of the bill they will wipe the acct clean.i thought there was a seven year law stating that if you have not contacted them within that time frame it goes off your crdit and you are no longer obligated to pay that. how do i know that they are not tring to collect on this again.and i also have another case were i now have a judgement and i received in the mail from two different collections agencies the same bill and im sure i paid those in full what do i do about that.im just tired of tring to get ahead and then something else coming up from a long time ago.im about ready to file bankrucpty but if i do that then i will have to also return the only car i have to transport my kids and get to work. and i will have that on my credit for the next 7-10 yrs.i loose either way.

Re: collection
No, you won six years ago, when the statute of limitations expired on this debt.
I am assuming here that you have had no communications from you to the creditor for twelve years. This answer is predicated on that understanding. if this is incorrect, then the following answer may be wrong.
Especially with the bottom feeder debt collectors who purchase debt like this, do not give them any information such as your bank account numbers or your SS number.
Have a fun moment by visiting www budhibbs dot com. I think he does a very good job 'splaining what is happening to you right now.
The important thing is not to go silent as to the outstanding judgments - be sure to write and demand verification of the debt. Write certified, return receipt requested. Mr. Hibbs even has a pattern letter you can download for this purpose.
You may not have to file bankruptcy - certainly not based on a 12 year old debt. Nobody is going to take your car so long as you make the payments.
They cannot take away your birthday, or your kids. They want you to think they can, and they act like hyenas because they are powerless.
The colllection notice on the 12 year old debt that you received - the debt collector probably paid pennies on the dollar for the right to collect that debt. If you send them 50% of that debt, all the money you send goes right into their pockets, and they are on commission!
Don't fall for it. Get smart; use google as a search engine for Federal Fair Credit Collection Practices Act.
If the people who sent you the collection notice on the 12 year old debt serve you with a summons and complaint, please don't hesitate to contact me.
