Legal Question in Credit and Debt Law in Washington

Collections

My husband cosigned for a loan for a motorcycle. The guy paid off the 2k loan. Years later he bought a brand new bike with that loan that turned out to be an in-house credit card. My husband was not aware of it being a credit card or he wouldve taken his name off. The guy didnt pay and wrecked it. Now my husband is being sent to collections years later. What can we do?

Re: Collections

The fact that your husband was a cosigner on a loan years ago is not a basis to attempt to collect a subsequent debt based on a different agreement. How and when did your husband learn that his name was on the credit card agreement? Did he object when he learned?

If the collector is driving you nuts go review budhibbs dot com and email me off line if you need more help.

I'm speculating based on the facts you provided, and cannot really analyze for you without reviewing the documents involved. Hope this helps, though - Elizabeth Powell
