Legal Question in Credit and Debt Law in Washington

debt back on credit report

I had an OLD cell phone bill where they refused to reconcile errors they admitted to making on my credit. I disputed it and it was removed on all 3 credit bureaus. Now 2 yrs later it is back on there under a new collection agency. I disputed again and they say it's valid. How can it be put on there again after it was previously deleted? it's the same debt!

Re: debt back on credit report

You should google Fair Debt Collection Practices Act. I could write a book on the underhanded tactics of some bottom feeder debt collection agencies. WHat has happened to you is called 're-aging". They will say that you made another payment to start the clock running again so they can set you up for a judgment.

Contact the agencies in writing, certified, return receipt requested. Say what you said here. If they refuse to remove it, you have a cause of action against the collector for reporting incorrectly and the agency for accepting the incorrect report. There is also a federal agency that you have to submit your complaint to as well, and then you can sue them.

There are attorneys who will help you with this knowing they'll get paid when the case ends. So they won't charge you to talk to you.

My favorite sites are pennlawyer.com and budhibbs.com.
