employment garnishment

Is it legal for my employer to garnish my wages without any notification or notice? I haven't recieved anything from the collections company or the employer until the garnishment appeared on my paycheck.

Also, shouldn't the initial collections company have contacted me with an offer to at least obtain dept collection via offering me a payment plan? I agree I owe this debt, and want to pay it, but was blindsided my this action. Thank you for any info you can provide.

A wage garnishment is predicated on a judgment. You need to go find out what court ordered you to pay your creditor, and look at the process server's affidavit of service.

No, they don't have to offer you a payment plan. Similarly, you don't have to tell them if you choose to bankrupt out of this debt.

It is probably dischargeable, so long as it is not a debt for child support or a student loan.
