Legal Question in Credit and Debt Law in Washington
How do I find info.
I had a credit card account with a major retailer that I couldn't pay. The credit card company sat on the account sending me letters that I could do nothing about. The cc company sold the rights to a debt collection company and so on and so on. Now the debt collection company is making noises again.
I know it's been over 6 years since I made a payment or the date of default. I also knoe the Statue RCW 4.16 has expired. If they come to my state and try to sue me, how can I prove that the account is time-barred? I am sure that the burden of proof would be on me, right?
There is no 'last payment date' on 2006's credit report. And on 2007's credit report it states ''The account is scheduled to continue on record until Oct 2007.
Thank you. Jim

Re: How do I find info.
Start by looking at budhibbs dot com where you will find a wealth of information about bottom feeder debt collectors.
I would also consider going to the superior court clerk's office in the county where you live and personally doing a name search on yourself to determine if the collector has filed suit against you, failed to serve it upon you properly and mis-advised the court of that fact.
