Illegal Repo?

My truck was repod months ago, I was never contacted as to if they were selling it or as to how much it sold for. I was served today for the remaining balance. They sold my 2002 dodge dakota for $700. I was over %60 paid off on the loan. Can I do anything? Do I have a defense. There was NO communication !

Probably not unlawful. Look at the contract you signed. It probably says that the dealer/seller reserves the right to reposess the collateral in the event the payments are not made on time. They don't have to tell you what they do with it once they have it - they figure you will contact them. Their failure to communicate is not a breach of the contract (if their contract doesn't require it) but I will bet money that the contract requires you to make the payments.
