Legal Question in Credit and Debt Law in Washington

Past due VISA bill

I handle my ederly mother's finances and recently found out that she has an old VISA bill of several thousand dollars that she never paid. The account has been bougt by a law firm who is threatening to take her to court. She does not have the money to pay the debt in full as they want. What exactly can they do? Can they put a lien on her house?

Re: Past due VISA bill

How long ago were the charges made? If the charges and/or card are really old, the statute of limitations may have passed. If this is so, be careful not to "reactivate" the contract.

If the statute of limitations has not yet passed, you should try to negotiate a settlement or payment plan with the company, and get a settlement agreement IN WRITING-- it would be a good idea to have an attorney look it over for you before signing.

If you can't settle, the collection company can sue your mother, and if they win (which is likely), they can garnish her bank accounts (take out money) or put a lien on her house.

I handle such cases, and would interested in speaking with you or your mother. Additionally, I have some ideas for free legal resources (clinics, help-lines, websites). Feel free to call or email me for more information.
