Can 2d Assault serve Military instead of prison?

Can a second-degree assault felony (first-time offender) choose to serve in the military instead of jail time?

Details: bar room verbal fight. One man said something like he f*** the other man's mother. Other man punched the sharp talker once in the face, which broke the jaw. Puncher charged with 2nd degree assault felony, prefers not to go to prison, and since we are in wartime, would rather serve a term in the military.

Serving in the military is not considered to be an equivalent "punishment" to jail. You need to get an aggressive defense attorney as what was said would be considered "fighting words" or words of provocation or incitement. Good Luck!
