Re: 4th degree assault
The most common definition is "any harmful or offensive touching." Although it can include putting someone in "reasonable apprehension" of injury, usually by way of a threat. It is the lowest of the assaults, a misdemeanor, has a maximum setence for an adult of 1 year in jail and a $5000 fine, although your son may not be an adult. As your son will likely qualify for a public defender I recommend you use the free services available and if you feel you need additional help, consult with me on how to best utilize the free services available.
