Assault

I had recently been arrested for Assault 4 DV, I had a prior case of Assault 4, but it was deferred to Disorderly Conduct. I had a no-conduct order issued but I had gotten it removed the Police used that to get into my house asking for paperwork on it being resolved which I had none of(later on when I was in jail they proved it was removed), recently my Uncle moved into the house. He's a ex-con, who has recently had trouble with the law for stealing beer and other items from the store. He's a alcoholic and mixes prescription drugs with his beer, he's known to be a liar and a thief. One day out of the blue he get's hurt some how, either falling off of his bike (as usual) or getting into a fight (as usual) and on his way to the hospital tells the medics that his nephew beat him up(he was drunk and high at the time). There's 2 witnesses that know I was in my room the whole day, and they never heard any fighting going on, mind you it's a trailer and you can hear the slighest noises. The guy is twice my size and a psychotic ex-con, I'm not violent to begin with but if I was I doubt I would mess with someone like him. My pre-trail is soon, I was wondering what should I do? Any advice is greatly appreciated!

Hire a lawyer. You can get a free public defender but they are over worked. You need someone who will get in touch with your two witnesses right away. With statements from them, the prosecutor may dismiss the case. Particularly if you (through your attorney) confirm your uncle's criminal history. This is important because if you are convicted or plea bargain on the new case it will revoke (get you convicted) on the old one. Contact me directly if you'd like my assistance.
