help

my boyfriend already is going to court for a dui from a yr ago, and he wasnt supose to be driving but he had to drive his drunk mother home and he got pulled over and he got a ticket i was wanting to know when he goes to court for the dui will they see that he got that and will the report say if there were any passangers so his mom can go infront of the judge and try to explain why her son was driving when he wasnt supose to. that way he has proof that she was in the car.

It is difficult to predict whether they will see the new charge or not. The new charge needs to be filed and recorded in the computer system. Then the first court needs to check the computer system for an update. At some point, the prosecutor's office will notice it and bring your boyfriend to account for it. The report will likely say there was a passenger. Whether it does or not, his mother can appear and explain the situation. Either way, the judge will likely say they both should have called a taxi.
